1. Introduction
Midway Innovations, LLC ("Midway Innovations," "we," "us," or "our") operates the Cape platform and website (collectively, the "Service"). This Privacy Policy explains how we collect, use, share, and protect personal information when you use the Service, and how you may exercise your rights.
By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, do not use the Service.
2. Scope
This Policy applies to information processed through (a) our website, cape-it.com, (b) the Cape mobile applications for iOS and Android, and (c) related web portals, communications, APIs, and integrations we provide. It covers subscriber organizations (commercial cleaning companies, "Subscribers"), their invited users (e.g., cleaning staff/technicians), and end customers that interact with Cape under a Subscriber’s account ("Customer Users").
3. Information We Collect
A. Information you provide: names; business name; business contact details; user profiles (roles, emails, phone numbers); customer contact details used for notifications; feedback and support messages; and billing details (processed via our payment processor).
B. Usage and device data: log files (IP address, timestamps, app version, OS, browser/device type), feature usage, interaction logs, scheduling/checklist activity, request follow-through and status updates.
C. Cookies/SDKs/Analytics: cookies, local storage, mobile identifiers, crash/error reports, and analytics events (e.g., app health and performance metrics).
D. Third-party integrations: information received from services you connect (subject to their terms).
E. Aggregated/De-identified data: statistics that do not reasonably identify a person.
4. How We Use Information
We use information to: (i) provide, maintain, and improve the Service; (ii) authenticate users and personalize experiences; (iii) process payments and manage subscriptions; (iv) communicate about updates, security alerts, and support; (v) enable interactions among Subscribers, their users, and Customer Users; (vi) perform analytics and quality assurance; and (vii) comply with law and enforce our terms.
5. Sharing and Disclosure
We may share information: (a) with vendors/service providers (e.g., hosting, analytics, payments) under confidentiality commitments; (b) with your authorized integrations; (c) in connection with a merger, acquisition, or asset sale; and (d) to comply with laws, protect rights, safety, and security. We do not sell personal information.
6. International Transfers and Security
Data may be stored and processed in the United States and other locations. We use commercially reasonable administrative, technical, and physical safeguards (e.g., encryption in transit, access controls). No system is perfectly secure; you are responsible for maintaining the security of your credentials and user access.
7. Data Retention
We retain account and profile information for as long as your account is active or as needed to provide the Service. After termination, we delete or anonymize data within a commercially reasonable period, subject to legal/recordkeeping obligations. Aggregated/de-identified data may be retained.
8. Your Rights
Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict processing of personal data, and to data portability or objection to certain processing. To exercise rights, contact support@cape-it.com. We may need to verify your identity.
9. Account and Data Deletion
Subscribers can delete accounts via in-app settings or by emailing support@cape-it.com (see the Delete My Data page for details). Technicians and Customer Users may request deletion through their Subscriber or by contacting us; we will coordinate with the Subscriber where applicable.
10. Cookies and Tracking
We use cookies/SDKs for authentication, preferences, analytics, performance, and security. Disabling certain cookies may impair functionality. If we publish a separate Cookie Statement, it will be linked from this Policy.
11. Children’s Privacy
The Service is not directed to children under 13 (or the applicable age of consent). We do not knowingly collect personal information from such children. If you believe a child provided personal information, contact us to delete it.
12. Changes to this Policy
We may update this Policy from time to time. We will post the updated "Last Updated" date and provide additional notice if changes are material. Your continued use constitutes acceptance of the revised Policy.
