Copyright / Intellectual Property Policy — Cape

1. Purpose

This Policy describes how Midway Innovations, LLC addresses claims of copyright and other intellectual property infringement ("Infringing Content") in connection with the Cape Service.

 

2. Subscriber Content and User Submissions

Subscribers own their data and are responsible for the content they and their users submit or display through the Service, including logos, branding, images, documents, and communications. Subscribers represent and warrant they have all rights necessary and that their use does not infringe third-party rights.

 

3. Reporting Infringement

If you believe material available through the Service infringes your rights, please send a written notice including: (a) your contact information; (b) a description of the work and the allegedly infringing material, including its location within the Service; (c) a statement of good-faith belief that use is unauthorized; (d) a statement under penalty of perjury that the information is accurate and that you are the rights holder or authorized to act; and (e) your physical or electronic signature.

4. Our Response

Upon receiving a compliant notice, we may remove or disable access to the material, notify the Subscriber or user, and, where appropriate, terminate repeat infringers.

 

5. Counter-Notification

If you believe your material was removed or disabled in error, you may submit a counter-notification with sufficient detail, your contact information, and a statement under penalty of perjury that the removal was a mistake or misidentification, and your consent to jurisdiction. Unless the original complainant seeks a court order within the timeframe required by applicable law, we may restore the material.

 

6. Reservation of Rights

Nothing in this Policy grants rights to our software, trademarks, or other proprietary materials. We reserve all rights not expressly granted.

 

7. Changes

We may update this Policy from time to time and will post the updated "Last Updated" date above.
